Present day divorced Fathers have a dream, too. A dream to not only see our kids again but to end a system of evil that profits by keeping good fathers from being a dad to their own kids. Women who game this system need to ask themselves what kind of person have I become to take a good father from children for my own selfish gain. Kids need both of their parents. A good look in the mirror is necessary for many women and perhaps a bit of psychological or spiritual help is needed if they can't play fair and do what is in the children's best interest. Unfortunately, the number of kids and dads affected are many with the prevalence of divorce and moral decline in our culture. Yes, we have a dream too; to end government sponsored family court Misandry and feminist gender bias that is warping women, society and our courts. The merchants of misery and bureaucrats promoting this system need to find an honest means of making a living. This racket has to stop. Otherwise, if we don't stop them, we will all ultimately pay the price for the current entrenched system of removing fathers from the lives of children for profit. Father's rights is the civil rights movement of today. It crosses all racial and socio-economic lines of our society. So, today we pay tribute to a great man, Dr. Martin Luther King, Jr.

Consider the following groups and their issues; Ethnicity equity issues, African-American struggles, Chicano Movement, AmericanIndian Movement, Genderequity issues, LGBTrights and gay liberation.

I think it's fair to saythat illegal aliens have more rights than the fathers that get caught inthe vicious cycle of family court.

It is time for change!

We as Americans have aconstitutional right to care and nurture our children, and these rights havebeen taken away by the activist judges and courts who profit from perpetuating and promoting an anti male,anti father agenda. What I find painfully ironic as i start myfourth year of brutal court battle, is that we have a serious problem in thiscountry of kids growing up without fathers. Every psychological study points to the importance of bothparents in children's lives, and how vital a father is in the life ofa child growing up. This is the message that needs to be conveyed to thepublic.

I, as all of you, wantnothing more than to be a father to my kids. Instead we arebeing brutalized by a corrupt, prejudiced, bigoted system that mostnormal people would find offensive and disgusting. The first step in thisstruggle, is to "not take it any more".

Rosa Parks one day had hadenough, she refused to give up her seat on the bus. She was not going totake it any more. This was the catalystthat brought about eventual change. It took many years of painful struggle, buteventually the courts and the system were forced to adhere to the constitution. Society could no longer look the other way and rationalize/justify racism any longer.

We as fathers are onthis "bus" together. We must stand up for our rights, we must do whatwe can to fight the horrible injustice that is prevalent in the courts, andmost importantly, we must continue the struggle for the well being of ourchildren.

Continuing the Fight (for our Children)

This parallel and tribute to a brave and determined father of days past has me opening my wallet today and sending another donation. This current story from Father's and Families is inspiring. It is a reminder that the fight to reform the unjust and corrupt family court is a long and arduous climb. It is THE civil rights fight of today. Justice has its opposition, however. We are up against a heavily financed lawyer lobby, highly motivated and organized womens' rights groups and a lot of well entrenched politicians that don't want the status quo rocked. They would rather try to vilify and discredit those who are seeking justice (and wait for it) a relationship with their own children. Isn't that in the Constitution somewhere? They want to continue to fill their own pockets and the state's coffers by hook or by crook, they do not care how it gets done. It is just somehow our patriotic duty to shut up, take it and let them annihilate the very foundation of our republic and familial relationships for their own collective and personal gain. Millions of dollars not only flow from the federal government to the state but also flows into the state DSHS budget from the unjust child support system that creates the incentive to block shared parenting legislation every year and create the male fault state and DV divorce. Millions of extorted dollars also flow to the law firms and to all of the cottage industries created by our corrupt court system of today. Our very government has become a system of legalized extortion, bigotry and abuse. The local and state governments and the Washington Courts themselves (as exhibited by decision after decision at all levels of their putrid courts) are against justice and equality for men and children. What they do day in and day out in Washington courts do VIOLENCE to the Constitution of the United States of America that they have taken an oath to uphold. You can't have it both ways and expect people to call you "your honor." There is currently no honor in the Wa Courts or the profession of law. Do not confuse a contrived legal code (called the law) with morality and honor. They are not the same. The monetary hit to the state and the courts themselves will be large if a true American patriot like Ron Paul were to get elected and cut off their corrupt spigot of federal funds from awful and wasteful programs like the VAWA Act. Another obstacle has been the press. Until now, the main stream press has been silent. The unfortunate Baby Sky disappearance this year made the public at large aware of what many of us had already known for some time. The Wa Courts and Senator Hargrove are responsible for this missing child, no more, no less. If this baby is not found, they should be charged with murder, never mind treason. It has opened many people's eyes to the fact that this isn't just about a bunch of "angry dads" who lost a custody battle. Even the average suburbanite can smell the stench of the Wa Courts bias driven industry now. Regardless, we know this won't change over night. Machiavellian causes rarely do. So, in looking at all I have in store and want to accomplish in 2012, I have to decide how much of my limited time I can contribute to this fight against this evil of our time called the family court and state sponsored rackets. There are many reasons why I have better things to do and limited time to contribute to this maddening travesty in the midst of our (once free) America. I can't even imagine how tough it looked for our past hero Spottswood Rice when fighting in the midst of the civil war era. But, even then in the midst of real racism, he fought on for his kids and fought the good fight. Something to consider for 2012.

I will say this, the numbers are growing and so will the class action, jury trial and federal law suits (Not a threat, just a prediction). This "father's rights" movement will not simmer down. It will continue to get more vocal, involved, organized (like the opposition and special interest women's groups) and it will also be a growing factor in upcoming elections. This email below from one of the Seattle peeps reflects what many men across this state (and country) now think about state sponsored and perpetrated extortion and abuse. The tyrants of our day might want to consider what is coming their way.

The Judge that heard my case today made Judge Churchill looklike the fairy godmother. My Domestic Violence Perpetrator ex cried to himabout how she is afraid of me and how she thinks that I am a threat to our sonwho is adjusting so well without me. She thought the assessment I haddone was done on line and questioned the validity of it. The Judge silenced meat every turn and agreed with everything she said. My motion for visitation wasdenied.
Excuse me, but I'm a little slow. I still somehow thought that I couldfollow the rules and get results. It has taken me a while to fullycomprehend that the DV courts system is a highly toxic and corrupt parade ofclowns that actively participate in destroying lives all the while assisting inthe disappearance, murder and torture of helpless children. This isgetting beyond personal. They've fucked with the wrong guy. No worries, I willdo everything by the book and within the law to bring these people down.

Yes sir, an all too familiar story for many who have been gored by the family court/Wa Courts bull. Olé ! Our founding fathers had much less to motivate them. Looking forward to a productive 2012. 7-Year-Old Girl Asks Santa for Time with Her Dad

Elena, the 7-year-old daughter of a Northern California Fathers and Families member, wrote Santa and told him this Christmas she wants flowers, earrings, and a puppy. But #1 on her list was "custady pappers that says I can see my dad more oftan."

Elena has been separated from her dad without justification, by a family court system that simply does not respect dads.

Dear VAWA County Law Purveyors - (Let's just start calling Thurston Cy courts for what they are since we have a national reputation for perfecting the VAWA and federal Title IV kick back scratch, the drug court racket aside) Note - Thurston and VAWA will be interchangeable henceforth in this posting. You are likely aware of the recent scandal and scrutiny of the King County courts since the disappearance of Sky Metalwala and the exposed gender bias of Commissioner Jacqueline Jeske that led to that unfortunate situation where an innocent 2 year old child is still missing. This Video recording of her ruling (@1:22) is very telling and exposes this judicial bad apple. Despite a similar systematic and prevalent gender bias, unchecked ex parte interference and a similar VAWA funds driven agenda, King County does video record their public hearings as exemplified by the video in the footer of this email. We also have taken note that in the Jeremy Hughes hearing in Hawaii that HI video records their public court hearings in that state too. Indu did an eloquent job appearing by telephone in that Thurston DV Inc created legal quagmire. I’m not sure what the charge to litigants is in these other jurisdictions when requesting a video copy (like your charges for audio recordings and court docs). But, I’m sure it could be made profitable for the court enterprises of Thurston County. If paper copies cost 25 or 50 cents (& $5 to put your stamp it), you could charge a ton for video copies. We'd pony up some more dough for a video. So, when do you think VAWA County courts will begin video recording hearings? Indu clearly has had a (even if unintended) beneficial influence on Commissioner Schaller as Chris has really improved her game and professional demeanor leaps and bounds over her past tendencies towards disrespecting male litigants and emotional tirades on the bench. My last experience with her was much less dehumanizing and humiliating than in years past. It was actually, unexpectedly quite pleasant and calm despite the same illogical outcome and blatant abuse/legal manipulation of a temporary restraining order that has ran on for years and years with no incident (prior to or since its inception). Side Note: A TCFCR Trick of the Trade Story for another day. The gender bias and road travelled are much better disguised now in VAWA County family courts. So, with Paula Cranky and Mama Bear retiring plus an improved Schaller riding next to Hargrove's commissioner, it might not be so detrimental (or as much of an insurance pool liability any longer) to now consider the profit stream that could be generated from video sales of your VAWA court performances. Budgets are tight and we all could use a little extra scratch. Isn't it all about the profit dollars generated in your courts and ancillary services? Sure, there are some died in the wool man hating feminists in the bunch. But, at the end of the day, isn't it really just all about the money? In addition to an added revenue stream for you, consider the WA Courts new posture and approach on public records and open government in our courts (Nast v. Micheals misapplication etc.). TC courts are no stranger to the latter. Video taping would be a step in the direction of having at least the appearance of transparency in our judicial branch of government. A good step in restoring the fallen public confidence in the Wa Courts. So, please, VAWA county courts, start video taping, restoring the public's confidence in the charade and make some more scratch in the process.

Why don't they record the hearings in Thurston as they do in most others venues? It is commonplace elsewhere. Perhaps they realize that public confidence in an inerrant racket is a tall order anyway. Others might say it is because hack judges like Casey and Wickham have become masters of tainting the written court record by interjecting comments and statements that could only be read in prejudice against the target litigant. This creates a favorable record for appeal and they are good at this tactic. The court reporters work hand in hand with the judges and commissioners. They are very crafty as to what actually gets on the record. I'm sure it's just for efficiency sake. Video recordings would not only correct these judicial malpractices but likely reduce staff overhead costs. So, increased revenues AND reduced overhead costs. Are we making any sense to government trained employees yet?

Another possible outcome would be the benefit of having some accountability for abusive behavior and outrageous rulings. Like Commissioner Jacqueline Jeske calling mom Metalwala a fit parent that poses no danger to anyone just prior to mom "losing" her son. Or like this King Cy commish in the video below (Les Ponomarchuk) who could sorely use some judicial canon review in addition to anger management classes. I kind of think his behavior is borderline DV in Schaller's self professed view of the 26.50 law. He is acting very intimidating and bully like and has obviously scared the respondent. Get out the Duluth Wheel, girls. We have a winner! There is definitely a present fear of this judicial officer of the court. A very useful tool this video recording is. Oh, they use the "temporary order" Court Trick of the Trade in King county too. You'll also notice that lieyers interfere with supervised visitations there, as well. It is also noted that they say a fit parent is "a threat to the children" when men don't drink the DV industry Kool Aid. A loving, fit parent becomes "not in compliance with treatment" when they refuse to be bullied into the DV industry's false allegation tunnel of love. This attorney (ex parte specialist Ms.Zaike) would fit right in here in VAWA county.

No court bias here . . .

PS - Joel Johnston makes a couple good points . . .
1. The pro se respondent mentions several times that Karman Icky (the lying attorney) had ex-partydiscussions with the Commissioner/Judge. She doesn't argue that point,she doesn't object to it. This is now evidence tobe put into a hearing. It is now a fact as a matter of record since she didn't argue against it or object. So, any of you officers of the court and state of Washington authorities who read this now have an obligation to report this violation. Hmmm and the beat goes on.
2. King Cy commissioner Les Ponomarchuk states that he is represented by an excellent attorney. It would be helpful if he would just give him the rest ofthe list of "excellent attorney’s" he would recommend (that have favor with his court), and a copy of the list of badattorney’s that come to "his" courtroom. We'd all love to know which one’swill have a better outcome when they are in front of Mr. Ponomarchuk. Down her in VAWA county it's easier to know since it's a small pond. Schaller's own law firm, Redford's Women's Law Firm and Con Em', Take em' and Misandry are the obvious front runners in any contest in VAWA county.

Granny shoots son in law during kid exchange

A calm "no, not now" evokes a violent response from this woman. This is typical woman on man domestic violence. In my past experiences with my ex, calmly saying no to her demands could and often times did provoke a violent response if not at least a verbal assault. You just never knew when . . . it's called walking on eggshells. I predict more and more of these scenarios will be recorded going forward since the family racket hacks won't acknowledge violent and abusive women. If women can get away with murder all on hear say and self serving testimony, men better start recording any and all interactions once they find themselves in the cross hairs (so to speak). You know when you are there. Trust me. Just record it because it is admissible as evidence if they are breaking the law. It will throw cold water on the kangaroo court drama. That would have saved me thousands of dollars and my relationship with my kids. In this man's case, as in many woman on man DV attack scenarios, she called 911 and tried to invoke the MANdatory arrest law and said he attacked her. Thank God this man had the foresight to record it and thank God Granny is such a terrible shot and was shooting a pea shooter. Although, a .22 bullet is nothing to laugh about if it lands in a critical spot, it could have been worse with a 9 mm or .45 cal.

So, Indu, Schaller, Senator Hargrove & the WSCADV . . . Is this domestic violence? Have we reached the "threshold" yet? Has this "risen to the level of domestic violence" yet? Didn't think so. Doesn't pay the bills, does it?

The family court racket abuse is finally out of the proverbial bag and into the main stream public eye for some long over due scrutiny. It has been said here before that too many people have been fleeced and too many bodies are piled up from this court's abuse. Their chickens have finally come home to roost. Tonight on the Ron and Don show they discussed with great amazement how Mr. Metalwala had to pay for an array of COURT ORDERED services and reports in addition to paying outrageous sums for filing fees, attorney fees; DV assessments, DV classes, GALs, GAL reports, Visitations with his children (that's a whole nuther story how a law abiding man becomes a for pay "visitor" in his own children's lives). ALL as a result of no evidence required family court false allegations. They also pointed out that most men don't have the means to do this and if they do, the system will milk them until they are dry and then spit them out without a penny. I've seen many a man ruined from this blood sucking and racketeering family court system. That's our government serving us thanks to a Senator Hargrove led legislature and his Bar Association/Women's Rights lobby groups. Ron and Don also pointed out that the mother (Julia Biryukova ) sent a representative to court for her (likely from some tax funded women's advocacy group) and that she would now like visitation with her daughter. She can't afford to pay of course 'cuz she isn't working and hasn't found her sugar daddy yet. So, Mr. Metalwala will likely have to pay for that too. OUT F'ing RAGIOUS. THIS MAKES MY BLOOD BOIL!!!!!!!!!!

So, with baby Sky missing and the recent Jeremy Hughes situation coming to light (more on that to be sure), I will be starting a new series called Family Court Tricks of the Trade. I will be exposing the dastardly deeds I have seen and have seen done to others. These recent cases have reinforced what I've wanted to do for a long time. This is the start of the list (so stay tuned):

4. What does "temporary order" really mean? How to make a temporary order permanent.

5. How to use a DV Protection Order to award (by default) a woman full custody?

a. How it maximizes child support payments for mom

b. How does DSHS benefit?

c. Do the courts get a cut or kick back from DSHS for child support they order?

6. How to enroll women in the Secretary of State's address confidentiality program.

a. Why?

b. What are the benefits to the court and attorneys?

c. What is required to be considered a "victim" and beneficiary of said filing status in this program?

d. Does this cost the tax payers?

7. How do divorce attorneys slander real property titles (a felony) in attempts to force payment of family court ordered attorney fees and to stop a man from refinancing his home.

8. How family court judges and attorneys force a home into foreclosure or force the sale of a home.

9. How divorce attorneys and mentally ill mothers damage a father's credit on purpose and how they enlist and co conspire with collection agencies, DSHS, doctors and GALs.

10. How women's attorneys stall or get the court to throw out any report until they get what they want and from who they want.

This is just the tip of the iceberg. ALL of their devilish, illegal and unconstitutional deeds will be exposed here. Stay tuned.

Good news out of a Washington Court! Amazing, but true!! Mark the calendar.

Metalwala Campaign Update: Father Wins Custody of Daughter, Only 1 Hurdle Remains (link to story)

This family racket commissioner (in the above video) Jacqueline Jeske states, after maneuvering around all of the evidence against the mother; "she does not present a danger to anyone and demonstrates good (she even had to pause to finish this load of feminist crap) parenting." This commissioner "found" (like Chris Schaller and Indu Thomas do in our local male extortion ring) that there was domestic violence and issued a restraining order to keep this dad and his kids apart without a single shred of evidence or ANY violence present. The state attorney goes on to say; "we can't establish domestic violence in the relationship. The mother has very profound mental health issues," said Tony Masco, assistant state attorney.

This Commissioner Jacqueline Jeske should be stripped, not only of her dishonorable black robe, but of any and all legal credentials to ever practice law again. It is absolutely CRIMINAL what she did in this case and SHE is solely responsible for baby Sky now missing . However, she'll probably just become another appeal and supreme court attorney with Patricia Novotny working alongside the WSCADV using our tax dollars. Better yet, why not put her up on the Supreme Court with gender bigot Barbara Madsen and her girls club up at that Court. She'd fit right in at Division Two Appeals court too. I can guarantee you this . . . The gutless & corrupt CJC will do nothing to this commissioner. It will be business as usual in the WA Courts once the "angry dads" quiet up and the press dies down. That is not a difficult prediction to make.

Even though it took a missing child to expose this current domestic violence racket to the public and put pressure on our lawmakers and elected officials and DSHS, to make a just and sound decision, this is a rare good news story coming out of the Washington Courts, indeed. I give credit to today's commissioner Galaher. He was already well respected by many for his rational, judicial and equitable approach. I praise God tonight for such an outstanding victory for this dad and daughter. They have been delivered from the clutches of evil. I wish all dads and daughters, who have been victimized by these evil family courts, could be delivered and reunited this Christmas . . . more than you will ever know.

We all need to keep praying for baby Sky. We all hope he is alive and well.

Commissioner Indu Thomas

It's always kind of interesting to see who is Google searching who. There have been a lot of Commissioner Schaller and Commissioner Indu Thomas searches as of late even from out of state. I always wonder if it's the insurance pool providers who are assessing the risk of insuring a gender bigoted court who could be facing a massive class action discrimination law suit or if it's just a potential new employer. If I spent 24/7 screwing over people, I'd want to relocate too. You can only shit in your own nest for so long. There's a reason Schaller lives in Tacoma and goes by a different name than her husband (Moss Adams CPA Christopher Kradjen), just like Casey-Handy and most of the rest. But, some of the searches I would guess are Schaller and Indu themselves "checking the pulse" so to speak. The 2012 judicial elections and appointments are rapidly approaching and I'm sure they want to gauge what kind of opposition they are looking at or how many screwed over dads are still alive and kicking in their jurisdiction.

So, Indu, if you're searching and checking the pulse out here, I can tell you this; there will be more written very soon. We've seen the Jeremy Hughes tapes from the Hawaii hearing you were involved in and we've got lots of info to sort through on that. Who knows with the Wa Courts loosening up administrative records to the public (as they always should have been), we might even shoot some PDRs your way and see what kind of email trails and ex parte communication has been going on. I'm not sure at this point how guilty you are other than your general association with an unconstitutional and abusive Thurston DV Inc. But, I do know this, Commissioner Christine Schaller-Kradjen (wife of CPA Christopher Kradjen of Moss Adams - both hob nobbin St. Martins' donors), John Tunheim and his lawyers at the PAO and Judge Wickhem look very, very bad in this outrage and travesty. There is more to come on this situation and story. Thurston DV Inc looks very, very bad and I'm guessing you played a role in it based on other decisions of yours from other cases.

The Hughes case aside, Indu is an interesting character in the feminist court of terror and family lawyer racket scene. She seems so nice and polite. The others on that bench can hardly keep their man hate aura from searing their own eyelids and keep from screeching when a real man walks into their courtroom. Never the less, even with better bedside manners than her colleagues, Indu states on this YouTube presentation to some Jr. college kids that she still gets death threats and has awkward moments at the grocery store. She says it "just comes with the territory." Think about that! What other profession do you know where "it comes with the territory?" Terrorists? Pedophiles? Revolutionary Leaders? (see video below - before it's taken down) How many other professions today have to worry about who they run into at the grocery store like a family racket commissioner or divorce/dv attorney? I am very surprised a smart and nice gal like Indu would do this for a living. This is America. You have choices. OCD. A sick Mom, a perverted and corrupt court.

No one wants to believe this is the face of a crazy person. She's not on a street corner carrying a sign for spare change. No. she drives a nice car (that still had gas in it), lives on the Eastside and (no surprise here) has convinced a Washington Family Court that she is the fit parent. So, here's how it works in family court especially this one. Guided by legal counsel (usually one of the junior lackeys of Connolly, Tacon, Meserve or Redford woman's Law most of the time here in Hazard), woman goes into berserk mama bear mode and will do and/or say anything to win the custody war and maximize financial support . "He's abusive", "I have fear of him", "bla bla bla", no facts or evidence will be presented and this court (or any gender biased Washington Court) will side with mom because it profits the state and the court. They actually have the nerve to call that a "Finding and fact of law." I am not exaggerating. So, in defense (which there is none) he may say she has OCD, BPD or is crazy or unstable and the court will say "How dare you, bla bla bla", "she is a woman" "bla bla bla." So, any attempt at getting her mental diagnosis on the table is squashed. It's called a motion for a mental eval or aka (in the legal racket), a "psych eval." The GAL, and any attorney I had, said that a psych eval motion would only enrage the court and hurt my position with them. Like that could get worse . . . I still had/have my testicles. The GAL who saw and called my ex for what she is said; "they don't see anything wrong with her." "No one is ready to hear that because it isn't a popular position and it doesn't pay their bills." So, even though there is at least a three generation mental health/OCD history and there is (by her own admission) a huge hereditary factor with OCD that is exemplified by her behavior and life that mirrors that of her matriarchs, there is no way in a Washington Court you are going to get it on the record. So, the net result is kids who can't see a loving and fit Dad resulting in scars and issues that will last them a lifetime. But, hey, nobody rocked the OCD boat and no woman was made to "feel" uncomfortable by addressing her issues. I've heard or heard of many oral admonishments from Schaller and Indu Thomas on the matter of airing facts that don't shine so well on the female of the species (as they see it). So, as long as mom is comfortable, the Bar union gets paid, and mom gets what she wants from this court, it doesn't matter how many other lives are ruined in the process. In the case of this 2 year old missing Bellevue boy, let's hope he is found and reunited with his dad who appears to be the fit parent in this case.

Going forward, would it be too much to ask to get the facts on the table before making a gender biased decision that endangers children and/or ruins father/child relationships? Would it be too much to ask to get this woman (or my ex) the help she needs to live a healthy and balanced life? Is it really realistic to presuppose that every woman is sane (& "perfect in every way") while every man is an abuser? Despite this court's history and track record of following that line of decision making, that still sounds crazy to even say it. But, really now, is that too much to ask from our (we, the people's) officers of the court? If they can't police themselves, would it be too much to ask our elected law makers to start passing some laws reigning this crap and them in? Why is that an outrageous request in this state? Why do we even have to ask?

The background ramblings by the Supreme Court, regarding the proposed new rule for disclosure of administrative court records, is half hogwash. The legislature did not create the Public Disclosure Act. We (The People) did, by initiative. These are our courts and they exist at our pleasure and are purposed to be representative of our will.

Former ramblings that asserted the erroneous contention courts are exempt from the Act, because they are not mentioned in the Act, are nothing more than a "grasping for straws" effort to avoid having records damaging to the courts disclosed. (While I cannot guarantee disclosure of records would send many a judge and other officers of the court to jail, or at least out of office, it's more likely than not). A host of legislative and executive agencies also are not mentioned. Still, they are subject to the Act.

The People's Act clearly states "government at all levels" is to be subject to the Act. We intended transparency of OUR government. We excluded no part of it in solidifying our intent and did not intend to leave disclosure of records of the most dangerous branch to the whims and convenience of a few self serving animators of our courts (judges).

The case of Nast versus Michaels was and is used to grow and support the current misrepresentation the People's will was to allow the courts to prance about doing as they pleased. However, it was about case files only. It did not reach the matter of administrative records. That was never an issue before the court. Instead, the Supreme Court took an opportunity to incorporate dicta and then use it to trod on the Peoples will and authority. Worse yet, the case evolved over the years and is now [miss]cited or misrepresented to support a contention We (the people) did not desire or intend to hold all of OUR government accountable through scrutiny of the backroom acts [and omissions] of our servants at the judicial level. (my own emphasis added)

Access to judicial branch administrative records: Proposed court rule ready for public comments

June 17, 2011

OLYMPIA — A proposed new court rule governing public access to judicial branch administrative records has been released for public input by the Washington State Supreme Court. The rule presumes open access to judicial administrative records, within the standards and guidelines of the rule.

Comments on the proposed rule must be received no later than November 30, 2011.

The rule was developed to fill a gap in existing state laws and court rules, which do not address public access to judicial branch administrative records. The Washington State Public Records Act does not apply to judicial branch records, and General Court Rule 31 addresses only records pertaining to court proceedings. Because they belong to a separate branch of government, Washington courts and judicial branch agencies are not governed by the Legislature but by the state Supreme Court, which adopts “court rules” to regulate the operations of the courts.

In 2010, the Board for Judicial Administration (BJA) created the Public Records Work Group, which includes members both from within the judicial branch and from outside groups interested in public access to judicial records. The Work Group recommended new standards and procedures for providing this access and creating the proposed “General Court Rule (GR) 31A – Access to Administrative Records.”

The proposed rule defines the types of records it pertains to, procedures for obtaining access to the records, sanctions on courts or agencies for non-compliance, exemptions, creation of best practices, tools for handling particularly burdensome requests and an effective date that would give courts and judicial agencies time to train staff and develop best practices.

The topper in the 2010 Olimpian paper has got to be Mr. Sexual Harassment (costing the county "meelyuns") Ed Holm as a TSA Body Pat-down specialist. That picture is Priceless. You folks made my day.

I had lost my sense of humor regarding "the law" and attorneys in general a long time ago. But, I have to say, these guys and gals are funny and brave. Seriously on the latter, you don't buck the well entrenched way of doing things here in Hazard or you are in for a long day in court and a difficult career in beloved Hazard. Oklahoma Legislator Blasts Family Law System

Representative Nelson (R-Oklahoma City), a child of divorce, said:

"[O]ur current divorce system is a racket that enriches attorneys and makes children and communities poorer. Divorce scars children and leaves them emotionally disfigured. The current divorce laws are perverse and they are destroying children and our society."

Representative Nelson spoke movingly about his childhood and watching the pain on his father’s face at not being allowed to spend much time with his son, as well as the financial privations the system put upon him. Nelson concluded with a call for a presumption of shared parenting after divorce.

BTW, we'll miss the Truther as he/she(?) pursues other endeavors in life. Despite light blogging this last couple of years, the Truther's exposes of this family court is now at an end. My time is up here. Somebody else will have to pick up the torch. It is time for me to put this aside for good with one caveat; I do reserve the right to pop in again if necessity warrants it. You know, poke the caged tiger and he swipes back. There are plenty of CTM related DSHS PDRs on deck if need be. Still many cards left unplayed sitting in the drafts folder. So, in sum, after years of connecting the dots, uncovering the dirt, watching and reporting, here is my final conclusion; it's the legislature. At the end of the day, it is simply the Legislature that is to blame. However despicable and detestable I find the players to be in this family law madness /racket, it all comes down to the legislature writing the laws that allow/encourage them to do what they do. These maniacally crafted laws encourage the court and women to behave badly, perjure themselves and sling no burden of proof false allegations when seeking financial and custodial advantage. Some women take full advantage. Many women don't game the system and many women would never tear kids and fathers apart for their own selfish needs. Most women have a good sense a fair play when it comes to sorting out, moving on with their lives and minimizing the impact on the development of their children. So, yes, it takes the laws and it takes a special kind of woman to take full advantage of said laws. It also takes a judicial officer with a special kind of leaning in his/her discretion and thinking. We just happen to have an abundance of that here in Thurston which makes it an extra special place to be. Beyond that, Judges and commissioners don't do what is right, they do what is "legal" and expected of them. They are obligated to tow the line even when their "broad discretion" could (and should) swing in the direction of the truth and justice. The Bar Union controls and dictates to the legislature in this state and they also make damn sure they have the right personnel in place in the courts, too. They have crafted and now have power and control of the perfect racket. Do with that as you will. Those are just the facts, Mam.

In other words, Todd (the mother) was unable to sort out false allegations from real ones. Into the bargain, Todd failed to protect her daughters from her own feelings and fears about what she thought may be happening, thereby perpetuating the girls’ own confusion about the nature of what daddy had or had not done.

So, given years of false allegations against Miller and the manifest inability by Todd to (a) distinguish fantasy from reality and (b) promote a healthy relationship between Miller and his daughters, the trial court did what so many of them do; it gave custody to the children’s mother.

In other words, it took a long, expensive and arduous climb to a Supreme Court and a qualified Psychologist's evaluation to call the mother on her bullshit. That is something this Thurston Superior Court and, for that matter, every level of the gender biased Washington Courts, refuse to do even when the evidence is presented to warrant at least an investigation or psych eval. You won't get this kind of ruling in Washington in any court. But, good for New Hampshire and good for children everywhere.

Conclusion:

And that, in a nutshell, is how courts should rule in these cases. They should make it clear that false allegations of abuse are not acceptable and that they will not be used to benefit the alienating parent.

It’s a simple concept that more courts need to grasp.

Happy Valentines Day! This is one of those days where I miss my little girl more than you can ever imagine. It breaks my heart over and over again that I can't hug her and tell her again how much I love her all the while her embittered or mentally ill mother tries to convince her behind a bullshit restraining order that daddy really doesn't love her in order to justify mom's and this courts immoral and unconstitutional actions.

Tell me again how in America this can happen to a hard working, church going, tax paying "fit parent" who hasn't broken a single law in his life. It's not a crime to get divorced but it should be a Crime to destroy a child's bond and relationship with one of their loving fit parents (even if it is profitable for the court jesters and the state).

SB 5317 - This is Mr. Kastama's latest efforts at bringing our state out of the family law dark ages. It was read on the 20th and referred to "committee" where it will predictably be killed by the Bar Association operatives, state-ists and Gloria Steinem revolutionaries in our state government. Shared parenting and the best interest of children would take millions away from DSHS and the state, millions from the courts and lawyers and power&control from the women's groups. Even though the feminist judges and greedy lawyers can unconstitutionally railroad any father (and trump any shared parenting legislation) with an unsubstantiated allegation of Domestic Violence, Shared Parenting will NEVER pass in this state. Too many greedy people with too much to lose to act in children's best interest. It's a Machiavellian thing.

I love the way this reads. The legislature is shocked to hear of the effect the family court is having on children and that fathers are actually important to kids' healthy development. Amazing! All along they just thought fathers were merely sperm donors and wallets. Hallelujah Church, can I get an amen, Sista? It's a light bulb moment for our fine representatives in the state government.

Another Victory for the California group Father's and Families. Click on the link for more on that. Aside from the ACLJ (not the ACLU), this group is worthy of a year end donation as you wrap up your annual donations and count your deductions.

There are several remarkable realizations that I have come to realize about the battle for family law reform that are astounding that I think most folks outside the blast zone do not realize. I will recap a few that come to mind from my personal experiences and after reading this update and article from F&F;

1. The feminist groups and the lawyers (including the elected judiciary) are anti-father.

2. It also follows they are anti Heavenly Father, anti American and unconstitutional.

3. The aforementioned (in #1) are well funded, well organized and aggressively crafting and adding to their racket. They are working together on many levels and have effectively created a RICO Enterprise and are by legal terms Racketeering.

4. A sizable amount of our federal tax dollars have been hijacked and are funneled back through programs like VAWA, DSHS reimbursements, NW Justice Project and other WA Courts funded projects to the law racketeers that are anti-father. The family court is financially rewarded and profit from what they do to fathers and kids.

5. There is a high correlation between lawmakers and other high government positions and lawyers. The judges and lawyers have taken over our government in case you haven't noticed. The legal system is now our enemy.

6. They are deathly afraid of PAS (Parent Alienation Syndrome) gaining acceptance as an accepted explanation for the opportunistic sick women who utilize these bully courts to snatch away children and destroy fatherhood.

7. They are deathly afraid of PAS gaining official DSM-IV acceptance.

8. They are deathly afraid of the truth getting out regarding gender and Domestic Violence. The research regarding gender and DV (not the government and law racketeers propaganda) reveals women are as physically aggressive, or more aggressive, than men in their relationships with their spouses or male partners.

9. There is progress in the war against the DV Industry. F&F Update. WADVPRESS.

10. The truth about DV and Parent Alienation would crumble the law racketeers empire. Imagine a gender neutral, factually based family court. Can you even imagine such a thing? Women would have no incentive to act like the power hungry beeotch the family court judges and lawyers encourage them to be. To quote the famous six string slinger from Seattle, the world will know peace when the power of love overcomes the love of power (and money). I added the last part. Without the incentive and unchallengeable advantage they have now, women would be forced to be reasonable and act like an adult. Children would benefit.

11. Change will not come from the inside of the law racket however well intentioned some lawyers think they are. Sadly, it is true what they say about the abusive family court and the general populace; People don't care until they have been gored by the bull. In other words, until you have been unconstitutionally steam rolled by this court, people stay blissfully ignorant of it and don't care to get involved.

Chris Schaller is immature, emotional, irrational, arrogant (why I don't know), a misandrist of the 1st order and was a terrible court commissioner. I won't go into all of the insider connections she has here and the path her dad paved for her in the legal racket. We've done that before and Gregoire, the CJC and the Bar Union all know the conflicts of interest she has running her court room. All of that aside, she will just plain make a terrible judge. She couldn't handle the little power she had as a commish and is not well suited for a position of power that requires a calm and rational mind. That is not her forte. She would make a great supercharged womens' rights attorney, not a judge. Obviously, I know what the Father's who have been screwed by her think. But, I have also heard many lawyers discuss her (in and out of the hallways) and it wasn't as kind as the respectable Tim Ford states in the article linked to above. He is being PC in his comments. I have also heard from women who think the same as I do. One mom's 14 year old boy was slapped with a felony on his permanent record for an innocuous and first time offense. Think she would do the same to a 14 year old girl? Think he's gonna have an easy time getting a decent job in the future? Think Schaller cares? You all know those answers. Additionally, I know she grew up in Hazard County. But, currently, or last we checked, her and her husband, Chris Kradjen (Moss Adams), lived in Tacoma per the public voting record and legal service address. Being a resident and property owner in the county you run for is a prerequisite to being a judge in that county or was?? What's up with that? Is she moving her CPA husband and kids back to Hazard now? Oh Joy. I hope we're neighbors.

How fair haired Bar Union members get a judicial seat -
Less than half the local bar union even responded to the vote regarding the Superior Court vacancy and they make it sound like she's a wonderful candidate and a crowd favorite. Hazard County politics and especially judicial placements by the Bar Association and political powers are not to be challenged (or challengers will pay). That's bully politics and the bully democrat courts of Washington. Anyone that stands up to the Bar Association and democrat bullies will be a target and if one is an active participant in the legal scam for a living, they will have a hard time. So, don't expect Schaller to be challenged by anyone during the next election after she gets her placement by Gregoire. Like most judicial elections in Hazard, there aren't many competitive challengers that will call a spade a spade and a gender bigot a bigot. Schaller will get appointed and Schaller will have her power hungry reign here in Hazard and will likely become an even bigger illogical man hating beeotch than Paula Casey in time if that is even possible. Make no mistake, we, the people will not be able to vote her out. The Bar Union and Democrat Bullies will make sure of that.

Gregoire - I happen to think you don't give a rip what we, the people think. So, I challenge you to prove me wrong. Please don't add another male hater to the bench. We have enough exacting damage on families and kids already. I would appreciate that and so would the Fathers and children of Thurston County. Show us that the Bar Union isn't really an arrogant, out of touch Rico enterprise that really does care about what we, the people think. Newsflash - The Washington Courts have very little credibility to anyone outside the legal racket. DOMESTIC VIOLENCE AWARENESS MONTH - "The Denver Story"

This is my story on how Domestic Violence began in my marriage. Yes, I do mean violence and I do mean SHE was the perpetrator. Growing up I was always the guy who would stand up to a bully for picking on a smaller kid and I would damn sure stand up to anyone who hit a girl or a female. I've had my share of scraps growing up with other guys as was the norm back in that day. But, I never dreamed I would ever be accused of violently or physically abusing a woman. Actually, she didn't really need to even go that far as to call it violence to get a "finding" of domestic violence. They have lots of ways to get around actual violence. In the family court, she can say anything she wants and her lies become "her credible testimony." You see these judges are given "discretion" (as though they have super human sensory skills) to determine the truth. He said she said is filtered through a judge's wise discernment filter and out spits the facts and justice. Really, that IS how it works. I had one De-witless attorney tell me and I kid you not, "Don't get all caught up in the facts and what really happened." "The court record has a way of creating its own reality." That was my attorney saying that. What a moron. I did have the good sense to walk away from that relationship very quickly.

So, shortly after getting married we moved to Denver. She came up the stairs one afternoon and into the loft where I was and began a discussion of some sort. Even now, I don't really remember it being anything earth shattering or even emotion laden. But, the more I reasoned with her and discussed whatever it was, the more angry she got. I remained calm and rational (which she later said is what put her over the top) and she began to talk louder and argue more vigorously. The calmer I stayed, the madder she got. She told me that being rational was somehow "cold" and she wanted me to react so she knew I cared about her. But, silly me, I continued to discuss the issue du jour with a calm voice and a rational viewpoint. I wasn't reading my exit queues very well. Finally, she snapped and exploded. She had gradually moved her way to standing in front of me by this point before exploding into a flurry of punches. At first, I was shocked. I kind of chuckled a little as I fended off her haymakers until one caught me in the cheek and another landed on my chest. It actually hurt like shit and I suddenly realized this is serious. She is actually attacking me physically and violently. I'm quite sure if we were in the kitchen by the knifes, I would have been toast (or sliced bread). I finally was able to get a hold of both of her wrists to stop her attack and let her settle down where I then released her arms. She was red faced and violently shaking. I never once hit her back or used excessive force to gain control of the situation. I asked if she was ok as she took a quick step towards me and turned and darted down the stairs. She left without a word until later that night almost six hours later I got a call from a hotel. In the interim, she had called her life long confidant (her little brother Steve) and told him the whole thing and said to me and to him that it scared her. Several months later he reluctantly acknowledged the phone call and incident. She said (at the time) that it was HER outburst and reaction to me that scared her. She didn't know what to do and didn't know how to explain it. After calling all over town, I now knew where she was and that she was ok. I proposed a cooling off period and left for a few days to go visit a friend in another state. Ironically, she denied this incident and little brother Steve never took the stand in court or at trial. I think he knew he'd also have to lie about "the Denver Story" if I had my chance to ask some questions of him. Hey, the kids got integrity. What can you say? Besides he's a Brother in the Bond. You're a stand up guy, Steve.

In hind site, I should have swallowed my pride and filed for a divorce and called it a day with her. But, I couldn't imagine getting a divorce. It would be the first with my friends and family. It didn't seem right to me to give up on it so soon. However, the reality is, there is no point in hanging in there and fighting for marriage anymore the way the courts and laws are these days. Also, what I didn't realize is that she would do it again many times over the next decade before accusing me of abusing her when she wanted an exit and full custody of our beautiful children. I can't imagine the horror and lies they have to live with now. I pray for them daily.

Hopefully, other young men can learn from my story and they will have the good sense to pack it in and move on when violence rears its ugly head from a woman. Women commit Domestic Violence and, most importantly, the is no accountability for Women who commit Domestic Violence. If she is violent or abusive, leave. There are many fish in the ocean. Life it too short.

Domestic Violence Awareness Month - Dating Advice for Men

Men - LEAVE WHEN SHE GETS VIOLENT. Depending on what research you want to cite, typically women have a greater propensity for violence than men do in hetero intimate partner relationships. Read the research not the womens' groups and WA COURTS propaganda. Do not kid yourself about a woman who is controlling and/or hits you. Violence is violence even if it seems harmless at the time. If you are like me, I grew up with brothers and friends and basically a guys' guy. So, it's easy to laugh it off when you can fend off a flurry from your ex with your outstretched arms. The first time it happened to me, I was shocked and bewildered and left the state for a few days. See "Denver Story" in my next entry. Unfortunately, the violence and tantrums against me didn't start until AFTER we were married (a very short time). I should have walked (no ran) immediately and filed for divorce. What I know now is that once you are emotionally and/or violently abused and/or attacked, they will do it again and again. These type of women feel entitled to do it and feel justified in thier actions. In their mind, it is always your fault and the family courts will see it that way too despite the constitution and "no fault" divorce laws. But, I was naive and "committed" to what I thought was a life long partnership (for better or for worse). Although, I don't know how worse it could have gotten with her abuse and threats. But, the point is . . . run, don't walk if you experience any violence or crazy shit when you are dating. I don't care how hot and sexy she is. It will get turned around on you at some point and you will be screwed by the legal system that has no burden of proof and an extreme bias (motivated by federal funds) against you (the male). I actually presented EVIDENCE that SHE was violent and hit me several times (in her own hand writing). They said I probably provoked her and deserved it and gave her the pass. There are many great women out there who are not nuts. You can't afford to mess around with a loaded gun pointed in your face and that is what Domestic Violence is for women. So, in sum, during the dating process is when you leave if she gets violent or abusive. Hopefully, you will be lucky enough to spot it in time. Move on and do it NOW.

DO NOT CONTINUE TO DATE OR MARRY A VIOLENT OR EMOTIONALLY ABUSIVE WOMAN. LEAVE AND NEVER LOOK BACK.

Women all over the country are obtaining domestic violence restraining orders at record numbers. Why? Domestic violence restraining orders are no longer only for men that actually beat their wives. Domestic violence laws continue to become more and more liberal. In California, destroying property is now considered domestic violence. For instance, if a husband gets angry and rips up a photo- domestic violence!

Why do women want domestic violence restraining orders? Simple: a quick and easy way to get their husband out of the house, gain full custody of the kids without Dad even getting visitation, and huge support payments from a sympathetic judge.

When a wife asks an attorney how she can get her husband out of the house, the attorney’s next question is about domestic violence. Do you get the picture?

California - The front line state in the Battle for Equality and Justice for Dads and Children

This just in from Glenn Sacks. One thing that is very true is that California is indeed the battle ground between the legal racketeers, militant feminists and those of us who want equality and justice and to be fathers after a divorce. WA DSHS and the Wa Courts paid for (ala yours and mine tax dollars) Barbara Lucenko and Owen Abbey to go down to Cali to report back on "better methods" and "best practices" for the Washington Courts Lawyers DV racket. No slander or malice intended here. Some well directed Public Disclosure Requests would back me on this. These are facts that were proudly reported on the WA Courts Web site and later taken down after they realized there are some slight conflict of interest issues and we (as Grace Huang puts it; "the well organized conservative backlash") were beginning to connect the dots in the WA Courts legal and DV racket. No personal disrespect is intended to point out that Barbara Lucenko is the wife of the TC Family Court fair haired womens' DV attorney Lenny Lucenko who happens to be a member of the Ukrainian American Bar Association. Huh? Ok, whatev. Again, not trying to start a shit storm or disparage anyone. Those are just facts that I'm sure the WA Courts, the Bar Association and the Thurston Judiciary are well aware of. BTW, Lenny and Suzie, do your senior partners know how often you frequent the right wing blogosphere while on the payroll at Con em', Take em' and Misandry? I digress.

Will we (in Washington) ever have representation like this from our elected officials? It's pretty clear to all paying attention that currently we do not have a representative government here in Washington. Our representatives are mostly lawyers who protect and grow government and legal empires and can get any unconstitutional family law DV crap rubber stamped and have it passed 94-0.

I applaud the California legislature and representatives for standing up for kids against the very powerful, organized and aggressive feminist legal lobby/special interests. I also applaud Arnold the Governator for signing on to these victories for fathers as reported in the latest Glenn Sacks email update . . .

F & F Passes 7 Bills in 2010, as Schwarzenegger Signs 3 More F & F Bills

This year Fathers and Families led the passage of seven different family law bills nationwide, as Governor Schwarzenegger recently signed the remaining three California F & F bills. F & F was also instrumental in helping defeat three harmful bills. The seven bills we were instrumental in passing include:
1. Alimony Reform (CA. SB 1482): Parents who face alimony increases after their child support ends will now be able to demand a vocational examination for their ex-spouses, and judges are required to calculate alimony based on the examiner’s estimate of the ex-spouse’s earning capacity.

2. Child Custody Protection for Military Parents (CA. AB 2416): Creates a rebuttable presumption that upon a servicemember’s return from deployment, child custody and visitation orders will revert to the original order. Allows judges to award a deployed parent’s parenting time to grandparents or stepparents so that deployed parents can’t have their contact with their children severed by the custodial parent. This also helps to maintain and nurture children’s bonds with their deployed parent’s family.

3. Child Custody/Visitation Reform (CA. SB 1188): Will help prevent family court litigants from using a parent’s disability as a way to deprive them of child custody or visitation.

4 & 5. Protection Against Family Court Financial Abuses (Arizona HB 2358 & Indiana HB 1165) F & F helped pass bills in both Arizona and Indiana which protected disabled veterans from family court financial abuses. Both bills were inspired by and modeled on SB 285, a bill we helped pass in California in 2009.

6. Child Support Reform (CA. SB 580) The high cost of medical care is a burden for everybody, but the healthcare obligations family court judges throw onto noncustodial parents can be devastating. SB 580 will ensure that noncustodial parents aren’t saddled with an unreasonably high percentage of their children’s medical care costs.

7. Child Support Reform (CA. SB 1355) Many young fathers who were incarcerated for nonviolent offenses face crushing child support debts which accrued (at 10% interest) while they were behind bars. These debts make it difficult for them to play a meaningful role in their children’s lives. This bill suspends child support from accruing while the obligor is institutionalized.
Legislative work isn’t just about passing good bills—it’s also about defeating harmful ones.

There is a nationwide reactionary backlash against recognition of Parental Alienation, and California is the battleground where it is being fought. The California National Organization for Women and the powerful, well-funded Center for Judicial Excellence in Northern California are leading the backlash, and Fathers and Families has been at the forefront of fighting it.

Bills F & F helped defeat this year include:
1. Parental Alienation in Family Court (CA. AB 612): This bill would have prevented target parents of Parental Alienation from even uttering the words “Parental Alienation” in family court, and custody evaluators and mediators would have been prohibited from citing alienation.

2. Custody Evaluators and Parental Alienation (CA. AB 2475): A complicated bill but the bottom line is that it would have led to child custody evaluators and mediators being punished for making findings of Parental Alienation.

3. Children and Medical Care (MA HB 930): Fathers & Families opposed and testified against HB 930, a bill supported by the Massachusetts Women’s Bar Association that would have further marginalized noncustodial parents in relation to their children’s medical needs.

Parent Alienation Syndrome (PAS) Recognition and Credibility

P.A.S. has long been vehemently criticized and opposed by family law profiteers and feminist groups (such as NOW). Despite their best efforts, PAS is now gaining more and more momentum and could soon to be included in the DSM-IV codes of the American Psychiatric Association. Many bills have been successful recently in California and other states helping to recognize and combat this problem. Family Law reform still has a LONG way to go. The proverbial pendulum has only just begun to swing back from the extreme side it now rests on.

This is a very good resource or link site on Parent Alienation as Child abuse on Facebook. It has long been argued that PAS is child abuse and it has been covered as an international issue for years as in this analysis on Parent Alienation. The point of this blog is not to condemn women who get caught up in it but rather to try to help them break from their damaging behavior and to seek some help (for every one's sake). Forcing your ex spouse into some ridiculous gauntlet of never ending feminist reconstruction classes designed to emasculate normal men is not going to make you feel better about yourself or help the situation. In fact, all the money you have costed yourself and your ex only takes away from the children's present and their future. Please understand that the children need contact with their father to grow up emotionally healthy regardless of the past failed marriage. In fact, all the more reason to move in a positive, healthy, loving direction. The kids suffer enough just from the destruction of their family. After your disappointment, anger and grief, you have to realize it's ok that the marriage didn't work out and you will be happier anyhow. This is what you wanted and you have to be grown up enough to acknowledge that rather than trying to make yourself feel better about it by playing the blame game. You have to come to accept it and move on with grace, forgiveness and yes even agape love for your ex spouse. It's not any one's fault and it doesn't matter anymore. This sometimes not so narrow path we are on is not so easy some times. Also, please understand that these people urging you into this position are making lots of money off of doing this and you are helping to perpetuate a very evil system of destruction of the family and of America. Why is there only one outcome in this family court that leads to their cronies getting new clients? Why is it they never interview the children or have a thorough psychological evaluation of all the parties involved before slamming a man into their programs? Why is it they stack the deck with only like minded CASAs and GALs etc who have the same Evergreen liberal education? Why is it the commissioners destroy evidence that doesn't support that outcome? I have several case numbers to back that up. I won't go into specifics on this post. But, suffice it to say that there are spiritual, socio-political and above all monetary forces at play keeping this system in place and encouraging this conflict. These are not Christ centered loving people running the show here. They are not professionally guiding people caught up in a difficult time to a harmonious and peaceful end. It is truly principalities of darkness who keep you embroiled in this quagmire and blinded from a real solution. Think about it. Did anyone ever encourage any kind of settlement, real negotiation or healthy solution? Winner take all, forcing homes into foreclosure, destroying your ex's credit (and yours in the process) and depriving children of a healthy, loving, involved parent is not healthy or even professional. That is not good for anyone, including you. Good for the lawyers and judges (I won't go into all of their incentives here). But, not for you in the long run. They are not your friend. The family court IS the PROBLEM.

Please, consider the children. But, also if you can't see beyond your hurt or pride, consider yourself. This is not good for women. Denial also harms women

Rocking Chair Test - When you look back to these times when you can only rock back and forth in your very old age, will you be glad you did it this way? Is this the legacy you want to leave your children? Will they be proud of the way you handled this? Do you want to face your judgment day with this on your plate the way it is now? God bless you. But there is another, unique ingredient in this witches’ brew: the women’s movement. For two generations now, a culturally triumphant feminism has validated the movement of married women away from homemaking and into the workplace, all the while successfully characterizing traditional marriage as the creation of evil, patriarchal men intent on repressing women. Many women, even women who would not consider themselves feminists, have internalized these attitudes, while many men, even men who pay lip service to feminist ideals, have not. When a consciousness-raised female marries an unreconstructed male, she brings ancestral attitudes that automatically aggravate her ambivalence. When she turns to divorce law for an out, she is welcomed by an array of economic and social incentive that encourage her to proceed. This amplification of women’s propensity to divorce may well account for virtually the entire doubling of the divorce rate since the 1960’s. It seems also to account, at least in part, for the uncharacteristically bad things that otherwise good women do to decent men.

The odds are 50% that your marriage will end in divorce. (I have posted the California Divorce Statistics that Lee Racounteur put together on the Don’t Get Married Board which is around 70%.)

The odds are 70% that your divorce will be filed by your wife.

The odds are 80% that your wife will get custody of your children – plus child support, alimony and/or a hefty chunk of your property.

From the moment your wife files for divorce, the State, acting through the court, will assert authority over everything you own. The court can then give a major share to your wife by applying the law of “equitable distribution.” The law of equitable distribution is based on the “partnership theory of Marriage.” This partnership theory of marriage doesn’t quite cover everything you made during marriage: it doesn’t cover your children.

Even though you and your ex were partners in the creation of your children, and even though you each contributed “equitably” to their upbringing, these considerations will carry little weight in court. Yielding to precedent and preconception, that court will commonly decide that it is in the “best interest” of your children to be in the sole custody of their mother.

As sole custodian, your ex will acquire primary paternal authority to live with your children and to determine their general development, including their health care, education, and religious training. You may “visit” with them on scheduled weekends (usually by paying a hefty sum to the lesbian supervised visitation house).

After the court awards your ex the sole custody of your children, it will award you something very special also. It will award you the obligation to pay child support (also known as MOM SUPPORT or aka income redistribution).

Ramblings from a Pro Se

This is not a Truther rant or the Truther's own work. I am passing along some "Ramblings" (not to be construed as legal advise, mind you) from one of the best and legendary Pro Se's and a true patriot to American principles of freedom, liberty and justice. These are our (we, the people's) courts, our laws and we have a right to have and express our opinions of them under the first amendment of the United States Constitution.

I would only add a couple things to the ramblings below. First, not only are bar complaints and AVVO.com a waste of time for reporting lawyers, but so is the Commission on Judicial Conduct (CJC) for reporting bad judges. The CJC is a huge joke, too. I would also add that if you are building a record in the family court, do so for posterity not the appeals court. Perhaps in Spokane where a credible appeals court exists that might make sense. Even there, it is likely going to get challenged and overturned in the highest state court which is back (guess where?) over here. But, here in the south sound, don't waste your time and money with the Division II appeals court in Tacoma. They are buddies with this local court and will not rule on the law or pursue the "ends of justice over procedure" (nit picky rules) that they can manipulate to dismiss what they don't want to rule on. Above the local appeals court is a Supreme Court Justice that has spent a career on gender biased causes and committees. You get the picture. Lastly, I like the idea of a reporting program for attorneys similar to what we have going on with http://ratethecourts.com/ for the judges. Some enterprising screwed over Dad should look into that.

Ramblings . . .

Generally, bar complaints are, at best, a fly-in-the-ointment thing and most effective when made a part of a bigger plan. Rarely do they get the attorney disbarred, even temporarily. The majority of disbarments that happen are reported to be due to that the attorney could not overcome the urge to reach in to the cookie jar (access trust accounts in their care).

Years ago, I started a parents' right group. As part of it, I put together a performance reporting program. It allowed people to report on the performance of the professionals with whom they came in contact. It required people to submit their reports in declaration form, so that when others asked me about a given professional, I could give them a copy of the declaration and not fear liable for making statements I did not know to be true. In promoting the program, I tried to educate people on the importance of only reporting documented facts, to avoid liable. In the end, it hurt a few arrogant dirt bags. For example, imagine a family law attorney who loses three active clients, and at least as many more, because of reports. That amounts to thousands of dollars of lost income. Keep in mind, that was in the days before the net and email. Those two things would vastly improve the impact of such a program.

If you are scheduled to have a hearing or trial, you need to demand, in writing, your attorney build a record. It is that record which will determine the outcome of any appeal. Reading cases taken to appeal, you often see proof favorable to the appellant and which should have produced a "slam-dunk," but then go on to read the higher court say "there were no facts IN EVIDENCE supporting the appellant's claims." MANY attorneys either don't know what a record is, or feign ignorance. I have heard attorneys, repeatedly, say the case file is the record. IT IS NOT! The record is testimony, including depositions moved into evidence, and other things properly moved into evidence (method set out below).

While a [competent (effective assistance of counsel)] attorney must have some leeway to run a case his way, it remains your case. In some instances, you may come to know of things the attorney should be doing to protect your interests and earn your money. In those events, you have the right to compel them to perform their contractual obligation (void contracts aside). It should be remembered your attorney cannot file criminal complaints for anyone but himself. Criminal complaints are the realm of prosecutors and AG's. An exception is in matters of theft. In such instances, it is called theft when the prosecuting authority pursues the matter and conversion when addressed by a client's attorney, to allow it to be addressed in civil court.

Attorneys are businessmen (actually, much of their training centers on this), first and foremost, regardless of any altruistic claims to the contrary (when considering claims made by them or their bar union, consider the Bible verse that said it best: "You will know them by their fruits."

Attorneys have developed the art of "being sincere, without really meaning it." Per their laws, their first duty is to the court. This, simply, means they may be sanctioned for acts that annoy the courts' animators. So, unless they think they can get away with it, they will always function to serve what they believe are a court's interests (remember, case files well document that courts often wander away from what is claimed to be the law they operate under). After that, their self interest kick in. In either event, your interest will be last in place. Rare is the attorney who would throw himself in front of a train to protect a client.

Attorneys have so complicated law, even they cannot know it (as of twenty some years ago, there were over three hundred million laws on the books). As such, the layman is lost to it. As such, much of what takes place in the courts is not the practice of law, but a dance with special effects, commonly called "smoke and mirrors." For example, attorneys, as a matter of routine, set up elaborate hearings to address contempt actions when their clients are unable to perform the act out of which the contempt was born. Because their client was unable to purge the contempt (e.g., the client cannot pay the money, produce the record, etc.), the contempt would, essentially, be killed. It is not up to the client to prove the inability, it is up to the other side to prove the ability. But attorneys play the more complex game and profit from doing so.

Your friendship with an attorney is a purchased thing and when the money runs out, so does the friendship. If it looks, up front, like the money will not get the friendship very far, the quality of the "friendship" will be adversely affected from the start. Compound this with incompetence and you have a recipe for client confusion and disappointment.

Perry Mason was not all that far fetched. He had paralegals doing much of his work, along with private detectives and secretaries. Unfortunately, this makes for a very expensive hourly billing. For the average individual to attain any semblance of this level of representation, he must take on the role of detective, paralegal and secretary.

From one Father to another and not to be construed as legal advice . . .

When you are thrown into this racketeering court by a bitter and vindictive spouse you are at an extreme disadvantage before you have even begun. Your wife has been setting you up for years. Hell, they even teach classes (for women only) at SPSCC on how to do it and women talk. They know. You are bewildered and spinning from betrayal, confused and heart sick over your kids being wrongly stolen and ripped away from you. There will be many that offer to help, all at a price (mostly hidden to you at the time) and known empty promises. The fact is, there is nothing you can do. You do not have rights in this court and a divorce is not just a divorce. If a woman wants to be ugly and make you pay for her emotional problems, all she has to do is make some statements about power and control or she is scared of you and it's over. You are done. Hard evidence against the woman or counterclaims of abusive behavior will only enrage this Court and sink you deeper in the quick sand. Do not waste your time pursuing justice in this court or building a record for the higher courts in this state. They are just as bad and belong to the same club that is designed to separate you from your money. It is a business not a court of law of the people, for the people and by the people. The kids are the key and the only leverage they have to get you to pony up all you have to engage in the war and be extorted. Whether you spend the money to fight them or get steamrolled into all the money programs they have set up for you, you will lose and you will pay. So, don't do either. I have heard stories of spiffs under the table buying some justice. But, as for me, I couldn't play that game even if I wanted to. Get in, get out and say goodbye to your kids. Women get drunk on the power they are given and turn into an animal you never imagined they could be. Once women turn the switch, that's it. Make no mistake about it, this is a MALE fault (not a no fault) divorce state. There is no rational mediating or wise, mature judge sorting things out. You ARE at fault for being male and having an opinion different than a feminist. The judge and commissioner will flat out tell you that you are wrong and they are not even subtle about it. So, minimize the damage, fight for the best financial deal you can get without spending a ton on lawyers and court fees etc. Mainly, though, kiss your kids goodbye. I was told this by several older men (business clients, associates and friends) and I did not want to listen. I wanted to believe in justice and believe that there was integrity and value in the higher courts and "the law" or that somewhere in our government there was somebody who would consider the facts, evidence and fairness and apply them all to the law that was somehow gender blind. But, that is naive. The only hope you have is that your (soon to be) ex will one day stop being a bitch. The Washington Courts will only embolden her and make a ton of money off of you. You can not win. They will even try to criminalize you, arrest you and harass you if you stand up to their bully system. A story for another time. If you do stay in and fight for the truth, document it the whole way in journal form and in building a good court record. Be clear, you are building a record for your kids, not a higher court. A good attorney will at least do that for you for the outrageous sums you pay them. Most, in this county, won't. So, shop for counsel wisely and stay engaged in your case and be prepared to fire two or three attorneys until you find one with a shred of professional integrity. Perhaps one that is fresh out of law school that hasn't yet sold out his/her knowledge of right and wrong for "the law."

Whether you are talking about attorneys or self centered borderlines, it's all about the money and it's all about women's dominance. You may be an asshole, outspoken or plain just not a like able guy to these PC Oly Libs and feminists. But, that isn't a crime. However, it is to them. Don't be naive about this court or the profession of law when you are thrown into this court. Get in, get out without waisting your time and money on pursuing justice. It is first and foremost a business and you are not carrying a bar union card. It is not about justice or our rights under the Constitution. I know you love your kids and your heart is broken, but only God and time can help you now. This court will not.

Women who wanted an easy way of out a marriage, and to assure custody of the children, eagerly signed up for "victim's benefits." All the woman had to do was say she was abused, and the domestic violence advocates eagerly welcomed a new customer. Never mind that the wife was playing fast and loose with the real facts: she was routinely abusing the husband and children, had mental or substance abuse issues, and/or was having affairs with everyone from the milkman to the soccer coach.

It became clear to me that the Parenting Act had been hijacked by the domestic violence industry. The good intentions of the Act's progenitors had been overcome by single-issue extremists. Every factor determining the children's residential time with each parent could be trumped by one nearly irrefutable claim: domestic violence. And even if domestic violence were not determinative, fathers were still losing. The Parenting Act, although written in gender-neutral terms, was usually being interpreted to favor mothers receiving primary residential care, even when both parents were substantially equally involved in parenting.

Today's featured article focuses on the need and importance of fathers in the lives of children. Written by Julia Steiny. She is a former member of the Providence School Board, consults for government agencies and schools; she is co-director of Information Works!, Rhode Island’s school-accountability project.

Some Highlights . . .
Glantz’s review of the research shows that the consequences of fatherlessness include:

• Higher risk of poverty

• Higher risk of abuse and neglect

• Increased rates of juvenile delinquency

• Increased substance abuse

• Earlier sexual activity

• Higher dropout rates

• Lower grade-point average

• Lower college aspirations

Why are fathers so absent, sidelined or marginalized? Apparently, child-welfare systems have been part of the problem.

“Dad’s love is valuable like nothing else.”

“Dad’s help transition kids into reality.”

“Moms hold on tight, protectively. Dads let go and encourage healthy risk, while still being reassuring.”

Conclusions . . .
Don’t misunderstand. Glantz says, “Fathers are not the end-all, be-all in a child’s life, but they are a critical piece. Father is a little piece of every kid. I would be advocating for mothers if they were as marginalized as dads.”

So however angry, resentful or blaming we may feel toward errant parents of either sex, Glantz reminds us they are still our best allies when trying to help kids succeed.

As it relates to this court (or the Wa Courts for that matter)
the question must be asked "Why are alienating mothers allowed to separate good dads from children?" This court does this routinely even when GAL reports are favorable (which is rare when they are in the same club and go to the same indoctrination programs) and the dad is found to be fit and involved. They do it even when abuse is identified in the woman and then rationalized by the commish or judge. This court will take a father out of children's lives even when there is no abuse found or even alleged against the father despite what the State Law (RCWs) clearly state regarding this practice. The higher courts uphold this judicial behavior and bias, as well. Is it the millions (of $$$$s) the state makes off of DCS collection and money transfers? No dad = maximum financial benefit to the state. Is it the legal fees to the lawyers (and judges)? Is it the women's advocacy funds (from public tax dollars) generated by propped up findings? Is it the federal DV/VAWA funding to the county and courts? OR . . . Is it just a clear case of gender bias in the Wa Courts comprised mostly of women and feminized males that are a product of the feminist revolution generation? Is it the multitude of programs that they have to support by ordering unwilling participants with coercion and taking the children hostage and using them as leverage and power against dads? I think there is a multitude of reasons of which is, not in the least, some very warped socio-political agendas. If you were to audit this court, how many times would you see the court or the family law attorneys in this court raise the issue of a man being white, successful, republican, conservative, Christian or military? At the top, though, follow the money trails. It's not hard to see why this court does what it does.

However, once the power trip has worn off from crushing your ex-husband in this court, the next question has to be asked . . . "Why would any caring and loving mother do this to their child?" That's the one question that stumps me the most. It will back fire on them when the kids grow up and get a mind of their own. They, at some level, surely realize this. I have personally met some great women over the last few years that carry the scar of fatherlessness or absent fathers from childhood with them into adulthood. Despite many great attributes and characteristics, this scar still affects them deeply to this day and every day going forward. Why would anyone intentionally and purposely do this to another person?

Growing up without a mom would be just as devastating, I'm sure. I love my mom dearly and recognize her many contributions to my life. I would never take a mom away from a child. I wish and pray that all people can separate their past differences, divorce and hatred for their ex-spouse from the children's needs and desires. It doesn't matter who you think is wrong or right from your past marriage. It is the PAST. No child deserves to be used as a pawn by this court or by an alienating parent. The other parent is still thier mom or dad forever even if they are not your spouse any longer. Putting your needs above the children's is not being a good parent. In fact, it can be argued to be child abuse. It is never too late to do the right thing. Seek wise and Godly counsel, not an attorney. Good luck and God bless.

Some good advice in the links below. Rise above the current divorce court culture. It is very profitable to destroy families and separate children from one parent. This court is running a multi-million dollar cottage (rather mansion) industry . . . the business of "family law." The State of Washington DSHS budget benefits too. Of course they will take one side and of course they do not care about the fallout on the children. They are merchants of misery who only care about making the most money for the lawyers, judges and the state. They are elitists who operate in the best interest of the state and themselves not "best interest of the children." That is a well over worn cliche they use in their PC meetings to pat each other on the back and convince each other that they are really good people just serving their sheeples. Think about the future and what impact your alienation will have on your children who are people unto themselves. All kids have a right to a relationship with both parents despite how you feel towards the other parent. Be a grown up. That's what being a parent is about. Does it matter that some family court wack job agrees with you and says you are wonderful for having the correct hormones and plumbing? Marriages don't end because two people still like each other or see things the same way. That doesn't mean your kids have to see it either way and you shouldn't force them to. If that doesn't sway you, ask someone outside of your "support" circle what the kids will think about you for keeping them from the other parent who loves them. The article is right . . . For the newbies stumbling onto this blog and just entering into the Tunnel of Thurston Love Court, here are a few basic rules for your edification and guidance. No charge.

TC Family Court Rule of Thumb #1: Woman (hear her roar) = Credible; Man (that nasty beast) = "Incredible"... that is to say he is not credible for those of you from Rio Linda.

TC Family Court Rule of Thumb #2: Woman hits man, his fault. He provoked it and refer to #1. Woman says man hits woman, he's guilty. Refer to #3.

TC Family Court Rule of Thumb #3: Evidence, what evidence. That will be ignored as will the Constitution of the State and of the United States. Due Process? Please. Try to keep up. They didn't take an Oath to uphold it anyway. It's no accident. It's not about the law, silly Gus, despite the promises of a family court attorney to win this one for you. Just pony up that $20K retainer. That oughtta last you for a few hearings and then you'll need to find some more. If you are really animate about justice, you can pony up another 30 or 40 Grand for the Division II family law shysters. The local appeals court is no better. Don't waste your time and money there, either. I digress.

TC Family Court Rule of Thumb #4: Women should always include the kids in a restraining order when filing for divorce especially if he is a good dad and makes a decent wage. Hey, it's leverage and how else are they going to get him to give a rip and shell out the dough. Refer again to rule #3 trailing commentary.

SPLITTING: Protecting yourself While Divorcing a Borderline or a Narcissist

SPLITTING is designed for anyone facing a high conflict divorce, whether or not your spouse meets the criteria for a Borderline or Narcissistic Personality. Its explanations of WHAT TO EXPECT in Family Court and WHAT TO DO to protect yourself and your children, can be used by anyone, including your attorney, your therapist, your family and others involved in your case.

I wrote SPLITTING after ten years as a divorce attorney representing many fathers (and mothers) whose spouses appeared to have Borderline or Narcissistic Personality Disorders or traits. Since I had been a therapist for the previous decade, I recognized these personality problems -- but I did not realize at first how successful they can be at manipulating and confusing legal professionals.

Rather than being rational and protective, the Family Court process can be very unpredictable and inadvertently encourages false allegations, aggressive and sometimes violent behavior, and intense blaming of the Non-BP or Non-NP spouse. Many Nons have been unable to protect themselves and their children from abuse by the BP or NP, and instead have found themselves experiencing restraining orders, supervised visitation, financial sanctions and even incarceration, because the courts are often more persuaded by the intense emotions and blaming behavior of a Borderline or Narcissist, than by your honest presentation of the facts. I call them "Persuasive Blamers."

This book explains how the Family Court process interacts with these Persuasive Blamers, and summarizes the lessons I have learned, including: the importance of careful preparations before announcing the divorce, using therapists and experts, avoiding short hearings on important issues, fighting hard at the beginning rather than trying to fix bad decisions later, and how to work most effectively with your attorney. I do not blame Borderlines and Narcissists, as they are also caught up in this adversarial process which often enables them to remain stuck rather than getting the help they need.

The 2nd amendment (The right to bear arms and the right to buy and trade guns)wiped and stolen from law abiding, tax paying citizens in the family court with nothing more than an allegation and self serving testimony of a divorcing spouse? Constitutional?

Due process of law, the right to face your accuser and the right to a jury of your peers . . . all overridden in the family court. Constitutional?

The right to freedom, liberty and the right to raise your children without government interference. All wiped by the family court with out due process, without criminal offense or without even a shred of evidence. Constitutional?

Property, assets and wealth stripped and transferred by a family court judge. Constitutional?

Homes forced into sale or worse, foreclosure, against the will of the owner by the family court lawyers and judges. Constitutional?

Prison time and police harassment or arrest for anyone who fails to pay child support. I thought the Constitution prohibited debtor's prison. Constitutional?

No accountability for family court commissioners' and judges' non-compliance with the law and the constitution. Black robes who operate without signing an oath to uphold the constitution. Again, constitutional?

Can you tell me why we let lawyers and judges police and oversee themselves? The CJC. The Bar Association. Are you surprised to hear that they have actually written into the law that they have complete immunity for their actions? Are you that untouchable on your job? Are you surprised when the higher courts and the CJC affirm and ratify unconstitutional and illegal acts of a family court judge?

Have any of you out there even read the Constitution? Does anyone care? (Until it happens to you?!)

Get off your fat, lazy duff and go read the rights you are supposed to have in this country that the judges and lawyers violate on a regular basis and have taken from you for their own personal monetary and political gain. If you don't care, then who the hell is supposed to care? Freedom isn't free and the march of legal tyranny is a relentless pursuit whether you are awake to it or not. Those who won't fight for freedom and liberty, don't deserve it. Please read the foundation of our country and state . . .

Ever wonder how the family law folks are fairing at plundering estates and fleecing couples that they have gotten worked up into a lather? Answer . . . not well. That is probably the best news from the down economy. Perhaps couples are working things out or simply just holding on 'til things get better. One thing is for sure, even if they do get divorced, they are wisely doing it without the unnecessary high cost of the family law professionals' "counsel" as reported in this posting back in April. The trend continues . . . It's Official: Recession Kills Divorce.

An Excerpt; Divorce is officially a casualty of the Great Recession. Rates are down for the first time in five years, according to the newly released study of the National Marriage Project. Michael Gerson has called this shift a kind of “cultural renewal”; the idea is that when times are tough, people connect with their cherished values and stop indulging in the kinds of luxuries a fat economy allows. Divorce rates also dropped dramatically during the Great Depression. The reality is, however, that divorce is just expensive. People can’t afford to get divorced during a recession.

It looks quite empty in the TCFC hallways these days and for good reason. Who says it's all doom and gloom in the news these days. Indeed, there are some silver (or perhaps Gold) linings.

NEW CAMPAIGN: Ask DSM to Include Parental Alienation in Upcoming Edition

A group of 50 mental health experts from 10 countries are part of an effort to add Parental Alienation to the fifth edition of the Diagnostic and Statistical Manual of Mental Disorders (DSM V), the American Psychiatric Association’s “bible” of diagnoses. According to psychiatrist William Bernet, adding PA “would spur insurance coverage, stimulate more systematic research, lend credence to a charge of parental alienation in court, and raise the odds that children would get timely treatment.”

Few family law cases are as heartbreaking as those involving Parental Alienation. In PA cases, one parent has turned his or her children against the other parent, destroying the loving bonds the children and the target parent once enjoyed.

Most people would agree with the old saying that family breakdown is hardest on the children. Now the phenomenon has a new name, parental alienation or alienation of the child, and families and professionals are trying to agree on how to make things better.

Parental alienation or alienation of the child — the experts disagree on a name — means that one parent will do anything within their power to make the child or children hate the other parent, including telling lies, denying access or even abduction. This goes far beyond the normal negative words spoken in moments of anger and frustration to the alienating parent consistently putting their own feelings ahead of the good of the children.

FRANKFORT — A Central Kentucky family court judge accused of judicial misconduct has been suspended for 45 days without pay and publicly reprimanded.

The Judicial Conduct Commission, the state's judicial oversight body, ruled that Judge Tamra Gormley, whose district covers Scott, Woodford and Bourbon counties, inappropriately handled two cases: a domestic violence hearing in Scott County and a child custody hearing in Woodford County.

A third count against Gormley, which stemmed from a child custody case in Scott County, was dismissed because the commission said the charge was not proven by clear and convincing evidence.

Gormley's attorney, William Hoskins of Lexington, said he reviewed the order Monday and discussed it with Gormley. Hoskins said they appreciate the commission for dismissing one charge but respectfully disagree with the findings on the other charges.

Hoskins said they are contemplating an appeal.

The commission released its ruling Friday — nearly a month after Gormley's hearing. The commission, the only entity authorized to discipline a sitting Kentucky judge, had until Feb. 19 to render a decision.

The ruling says Gormley violated a man's due process rights in a Scott County case. The commission said she held a man in contempt without advance notice and without his attorney present. Gormley did not witness the actions outside the courtroom that led to the contempt charge.

The commission said that while "a court undoubtedly has the power to hold a person in contempt of court for actions outside the sensory perception of the judge" (as was true in this situation), it "may not exercise that power without holding a hearing that provides the person with advance notice of the contempt proceeding."

On the second count, the commission found that Gormley entered a change of custody order that removed a child from the custody of her father but denied the father the right to put on his own evidence. Gormley, the commission found, acted as an advocate for the mother in that case.

Gormley's actions "were not mere legal error," the ruling says. "A reasonably prudent and competent judge would conclude the conduct of Judge Gormley to be obviously and seriously wrong in all the circumstances of the cases."

Hoskins disagreed. The commission did not cite any Kentucky law that was violated, he said, and there were no independent witnesses who testified against Gormley during the hearing on the charges.

"We truly believe Judge Gormley applied the appropriate Kentucky law and did so in good faith," he said.

This may come as no surprise to anyone . . . DV courts, lawyers and laws are not primarily about protecting vulnerable individuals from heinous perpetrators of violence. Big shocker . . . it's about the money! $$$$$$

Granted, some research and investigation needs to be done in this area. This is by no means a scientific study at this point. But, I've heard enough stories to start drawing a hypothesis to support with further study and to document a pattern. In recent discussion with some others on a few cases brought this stark reality to light in graphic detail. A Thurston County womens rights lawyer recently told a woman to flee the state (despite having a hearing scheduled) because they knew the perpetrators were violent and had no financial resources and the woman also had no money. Other cases display a similar pattern. No money and a real offender, flee. When there is no financial incentive and the perpetrator is a real violent criminal, the DV lawyers counsel women to cut and run. In contrast, look at who they do go after . . . middle to upper class men with money. Men that are involved fathers who give a rip and have assets to plunder. Paychecks get garnished, homes get forced into sale, attorney fees become liens and judgments and attorneys rack up the fees and the courts reward them. All of this as a result of unfounded and unsupported false allegations, no evidence is required. They actually wrote that into the law. Women go along with the game because they get to keep the kids and gain the satisfaction of screwing over the ex. It's an intoxicating potion for some women. These DV attorneys know that tax paying, honest citezens involved in the community (men) aren't going to respond the same way a violent felon will. These DV attorneys are cowards and predators. Yes, predators that are admittedly smart . . . like a fox. They know who to go after. Why chase a junk yard dog or pitbull for no monetary reward just for the sake of protecting the vulnerable when you can fleece a tame little house dog for lots of money? I understand. That's a no brainer. Junk yard dogs bite and that hurts! Besides, they have the house dog's pups held as ransome.

Again, no surprise to anyone. But, I'd like to see someone do some research and document this pattern for the legislature to show how these draconian, unconsitutional laws (as they are now) are not in the publics best interest and are actually damaging to their voters and damaging to children. Despite some well intentioned law makers and activists, these laws do little to protect the vulnerable and punish the violent. It is about wealth redistribution to the members of the bar association and the ancillary court service providers. It is a racket, plain and simple. The bar association is a private organization with no real oversight. It should be a government agency with elected officials; elected by we, the people not thier cronies. Judges are immune from unlawful acts and shielded from consequences for violating the constituion. The Judicial Conduct committe is comprised of private individuals who are part of the same private club, as well. So, we the people's courts are not run by we, the people . . . we only pay for them while a private organization runs them for their own profit and we are supposed to have confidence in the court system and judiciary? I wish tax dollars would pay my business overhead!

The dirty little, not so secret, secret is . . . DV is BIG BUSINESS.

The story sounds like a bit of a fanciful, mystical tale written in part to entertain and captivate the attention of readers in order to get the broader more serious story out; How the DV Industry destroys and how women use it as a tool of destruction and control. His life was nearly destroyed and ended up out on the street before finding redemption. For some, it does and can destroy men and children. Some, however, are too strong with the power of God (and the help of others) can and will triumph and persevere. Regardless, this story line happens a lot in our local family court here in Thurston County. I have come to know many, many stories over the last several years. One parallel to the book is for sure, these family court perpetrators are pure evil. It sounds like a good read.

The Governor mulled over various follow-up activities, but made no specific commitments. Nevertheless, I had the feeling that there will be continuing dialogue in some form. Peter Hill shares my view. He wrote, “This was a tremendously positive meeting. Family Court Injustices to Men

Did you know that a family court can order a man to reimburse the government for the welfare money, falsely labeled "child support," that was paid to the mother of a child to whom he is not related? Did you know that, if he doesn't pay, a judge can sentence him to debtor's prison without ever letting him have a jury trial?

Did you know that debtor's prisons (putting men in prison because they can't pay a debt) were abolished in the United States before we abolished slavery, but that they exist today to punish men who are too poor to pay what is falsely called "child support"?

Did you know that when corporations can't pay their debts, they can take bankruptcy, which means they pay off their debts for pennies on the dollar, but a man can never get an alleged "child support" debt forgiven or reduced, even if he is out of a job, penniless and homeless, medically incapacitated, incarcerated (justly or unjustly) or serving in our Armed Forces overseas, can't afford a lawyer, or never owed the money in the first place?

Did you know that when a woman applying for welfare handouts lies about who the father of her child is, she is never prosecuted for perjury? Did you know that judges can refuse to accept DNA evidence showing that the man she accuses is not the father?

Did you know that alleged "child support" has nothing to do with supporting a child because the mother has no obligation to spend even one dollar of it on a child, and in many cases none of the "support" money ever gets to a child because it goes to fatten the payroll of the child-support bureaucracy?

These are among the injustices that the feminists, and their docile liberal male allies, have inflicted on men. The sponsor was former Democratic Senator from New Jersey and presidential candidate Bill Bradley.

His name is affixed to the Bradley Amendment, a 1986 federal law that prohibits retroactive reduction of alleged "child support" even in any of the circumstances listed above. The Bradley law denies bankruptcy protections, overrides all statutes of limitation and forbids judicial consideration of obvious inability to pay.

Most Bradley-law victims never come to national attention because, as "Bias" author Bernard Goldberg said, mainstream media toe the feminist propaganda line, among which is the epithet "deadbeat dads." But one egregious case did make the news this summer.

Frank Hatley was in a Georgia jail for more than a year for failure to pay alleged "child support" even though a DNA test nine years ago plus a second one this year proved that he is not the father. The Aug. 21, 2001, court order, signed by Judge Dane Perkins, acknowledged that Hatley is not the father but nevertheless ordered him to continue paying and never told him he could have a court-appointed lawyer if he could not afford one.

Hatley subsequently paid the government (not the mom or child) thousands of dollars in "child support," and after he was laid off from his job unloading charcoal grills from shipping containers and reduced to living in his car, he continued making payments out of his unemployment benefits.

But he didn't pay enough to satisfy the avaricious child-support bureaucrats, so Perkins ruled Hatley in contempt and sent him to jail without any jury trial. With the help of a Legal Services lawyer, he has now been relieved from future assessments and released from jail, but (because of the Bradley Amendment) the government is demanding that Hatley continue paying at the rate of $250 a month until he pays off the $16,398 debt the government claims he accumulated earlier (even though the court then knew he was not the father).

This system is morally and constitutionally wrong, yet all the authorities say the court orders were lawful.

Another type of feminist indignity is the use in divorce cases of false allegations of child sexual abuse in order to gain child custody and the financial windfall that goes with it. Former Vancouver, Wa., police officer Ray Spencer has spent nearly 20 years in prison after being convicted of molesting his two children who are now adults and say it never happened.

The son, who was 9 years old at the time, was questioned, alone, for months until he said he had been abused in order to get the detective to leave him alone. The daughter, who was then age 5, said she talked to the detective after he gave her ice cream.

There were many other violations of due process in Spencer's trial, such as prosecutors withholding medical exams that showed no evidence of abuse and his court-appointed lawyer failing to prepare a defense, but the judge nevertheless sentenced Spencer to two life terms in prison plus 14 years. Spencer was five times denied parole because he refused to admit guilt, a customary parole practice that is maliciously designed to save face for prosecutors who prosecute innocent men.

State orders audit of Marin family court

Prodded by Sen. Mark Leno and other lawmakers, the state Joint Legislative Audit Committee voted Wednesday to investigate the family courts in Marin and Sacramento counties.

The audit will focus on the use, and potential misuse, of court-appointed specialists in family-law disputes, such as mediators, investigators and therapists.

Critics say such appointees can form incestuous and incompetent networks more concerned with generating fees than helping children through painful custody fights.

"It becomes a service mill, a cottage industry of sorts," Leno said in an interview Wednesday.

"Maybe state law needs to be changed." (Ya think?)

Our prayers and well wishes go out to this American boy and his father. This is an extreme case of parent alienation syndrome and shows how the psychologists for hire contribute to the syndrome. This is a heart warming story where (finally!!!) a court got it right and this boy appears to be coming home to his country and his father. May God further protect them from the minions of evil that pray on children and fathers. Nice to see a court (any court) rule for a father and his child and nice to see Brazil join the 21st century.

Judge Judy slams woman for "gaming" the DV system

Queue it up to 5:30 to hear spanking #1 where the good Judge tells this woman/girl "You had no basis for a restraining order."

In the part II at :40 you can hear a judge tell her "This is the United States of America" in reference to not serving him properly with notice of a hearing (take note Mike, Mr. Super Victim Lawyer). The judge goes on to say that he better have a lawyer because she knows the DV tunnel of love he has just entered. Let's hope in his county there is actually a lawyer who will defend an innocent man of such charges and is not part of the illegal DV racket. Lastly, at 2:09 the Judge called her on "Gaming the system" and shames her for "using it as a weapon and not a shield." This woman, and all women who game the system, should be ashamed and prosecuted not rewarded. However, she (like most) just didn't "get it" because she is too wrapped up in her Narcissist-Borderline world.

This is not surprising news when judicial conduct committees and lawmakers are members of the same fraternal disorder and do nothing about constitution smashing and law breaking judges. We have an entire roster of county judges (plus two nearby, but we won't name names) that have failed to file oaths of office with the Secretary of State as required by our constitution. That omission technically leaves their offices vacated for two terms now. The CJC and "powers that be" know all about it and have done nothing. The good citizens of Minnesota have had enough and are taking action as this story points out in the AmericanFreePress.net.

Legislators say they’ll impeach, remove questionable judges

In response to dozens of petitions by the citizens of Minnesota, an ad hoc committee has been scheduled to hear the evidence of the corruption within the Minnesota judicial branch.

The ad hoc committee was formed because the chairmen of the Senate and House committees that oversee matters of the judiciary have refused to hear the citizen petitions.

The evidence given to the ad hoc committee is massive and includes transcripts being altered, bribery, extortion, denial of access to the grand jury and numerous felonies by certain district and appellate court judges. Bills of impeachment against many judges will be brought.

Never before in the history of the state of Minnesota, and perhaps the nation, have the legislative committees charged with overseeing the matters in the judiciary refused to listen to the evidence of crimes being committed by judges.

Article Six, Section Nine of the Minnesota Constitution clearly shows it is the intent of the people for the legislature to discipline the judicial branch. The courageous legislators who have agreed to participate in the ad hoc committee number over a dozen and more are joining as citizens from across the state meet with their legislators.

Commissioner Indu Thomas Observations

Well, we said we were going to report what we “found” on the new commissioner sent from the legislature back in the September of 2008 Blog. We waited and watched some things develop and conclude as they relate to that story. Those of you “in the know” know that we know what happened there. I won’t say a word about it and disclose that specific case because it was amusing to see someone work them harder than they’ve worked the less savvy and less prepared (as they always do). It was noted to see Redford carry the water for the court, as well. A sort of changing of the guard (at least temporarily) from Connolly, Tacon and Meserve-Szurszewski Law Firm. Some of our Peeps have said that she was nice, considerate and approachable when sitting on some of the legislative committees for shared parenting a couple years back. It is no different than her behavior on the bench now so we have heard. She is said to have a good bedside manner so to speak. That is in stark contrast to the other commissioner who is known for her rudeness, obvious female bias and outright power tripping. However, the outcome (end result) and gender bias appears to be the same. We have documented and verifiable instances of destruction of evidence (a felony) and collusion with court administration and other judges. You can put lipstick on a pig, but it is still a pig. The new and improved Family Court web site is a perfect example. I have to hand it to the PR folks and web designer; it looks like a nice place to go now. It looks like a place you’d want to take your kindergarten class on a field trip to have milk and cookies with Casey and hear about the new art work. Please. We all know better . . . lipstick.

Granted, this is not an exhaustive, scientific study. But, that might be a good idea for the WA Courts or CJC. Somebody is supposed to be watching them, right? Well, here is a couple stories we have heard for our case and point; 1. One woman was shown to have been practicing the oldest profession in a car right in front of her baby/toddler. Indu’s reported response to the evidence? She allegedly ordered it to be destroyed saying “no woman should have to face those kind of allegations.” Even when it’s true and in the evidence? Really? All the rights of a man, just not the accountability, evidently. 2. A woman (a current case in front of Indu) has allegedly threatened to kill the divorcing couple’s kid. Two friends witnessed it and testified to it (allegedly, of course). Indu’s response? “This woman is being railroaded.” Again . . . even when it’s true? She and the rest of her family court comrades would be licking their chops if the gender roles were reversed on that one. It’s more profitable that way. Right Mike? This weekend the 4 year old girl went to the mom’s house and had to share a bed with the new boyfriend’s 14 year old son. Betcha that doesn’t make it in the record, either. The blood will be on the court’s hands when the obvious outcome unfolds here. The Super Victim Volunteer lawyer himself is in a fight he can win this time against an uneducated Pro Se who he (Oh, oops) forgot to serve documents before setting up the last hearing. Impressive, Mr. Victim lawyer. What a tireless advocate of justice you are. Blood will be on your hands too. But, congratulations for all your recent accolades from your bar buddies.

Look, Indu is probably a nice lady. I’m not trying to roast her personally. But, let’s just call it what it is. The TCFC is a racket. It’s a profit center for the local law firms, the county itself and the state (DSHS). It isn’t going to change without federal intervention, changes to VAWA, Shared Parenting Legislation or some kind of federal grand jury. I do believe the next generation of kids that needlessly suffered will likely lead the charge for family court reform. But, for now, there is too much money at stake here and the powers that be in this state like it this way. They know all about it. Don’t think they don’t. You don’t see the CJC rushing in to take corrective action after years of well documented complaints for the same court personnel going back decades. You don't see Hargrove and his cronies getting on board with Kastima and Shared Parenting despite the mounds of evidence from real children's advocates. No, what you see is nimrods like Brendan Williams being dictated to by the DV lobby and Pet DV laws passing 94-0. No amount of lipstick on this Pig or a new commissioner with manners is going to bring justice to this court or serve “the best interest” of children. It’s sad really that profiteering and feminism can warp the minds of so many once well intended people to where they can justify these kinds of ends. It’s truly a sad time in America for lady liberty and lady justice. Rico Sauve, Baby and Ka Ching!
