Miami, Florida - Miami attorney Jack Thompson “let slip the dogs of war” upon the State of Florida by filing a bombshell lawsuit today in the United States Court for the Southern District of Florida. The lawsuit comes at the intended culmination of years of persecution of Thompson by officials and operatives of the Florida Bar which has tried to disbar Thompson in an outrageous series of fraudulent hearings. It seeks a declaratory judgment and injunctive relief. It sends a message to the bar and state officials: leave Jack Thompson alone.

The lawsuit focuses upon forged and otherwise defective loyalty oaths by two judges appointed as disbarment proceeding referees. One judge, Dava Tunis of the 11th Judicial Circuit, originally appointed by governor Jeb Bush, presided in an illegal 9-day hearing for Thompson’s disbarment by and recommended “guilty” for nearly two dozen bar complaints against him. The other judge, Orlando Prescott, presided earlier this year over the illegal disbarment proceedings of Montgomery Sibley, for whom the officials suspended bar membership for 3 years, effectively destroying his law career.

The pleading alleges that the judges in question not only had forged oaths, a fact proven and announced last week by the State Attorney’s office in Miami, but also that they failed to swear subsequent loyalty oaths before a notary as required by US and Florida laws. Thompson pointed out the gravity of such a failure, making reference to 4 USC 101, the codification of the very first statute passed by the United States Congress (1 Stat 23). He also explained how the US Supreme Court made the loyalty portion of Florida’s oath a federal question when it ruled in United States Supreme Court in Connell v. Higginbotham, 403 U.S. 207 (1971) that it had validity and must be sworn by Florida’s public employees.

Jack Thompson gained fame (see http://en.wikipedia.org/wiki/Jack_Thompson_%28attorney%29) by pressuring purveyors of prurient material to stop purveying them to children. His efforts drove Howard Stern underground to Sirius pay-for-radio, and importuned both Two-Live-Crew for their vulgar rap lyrics, and the makers of the Grand Theft Auto for encouraging impressionable children to commit acts of violence. The wealthy opponents hired law firms to attack Thompson, and that led to disbarment proceedings against him.

In the process of mounting a defense, Thompson discovered the loyalty oath violation epidemic unearthed by legal researcher Bob Hurt of Clearwater Florida, documented at http://www.esnips.com/doc/21dcf8c0-f153-4c58-80b6-01621d4f6087/loyalty_oaths_in_florida. Hurt claims that lack of proper loyalty oaths violates an array of criminal laws. Hurt’s two-year efforts to expose the lack of compliance with loyalty oath laws led the State Department in June 2007 to restore the jurat (notarization area) to election forms after officials had unlawfully removed it in the year 2000. Hurt’s efforts also convinced the Chief Justice R. Fred Lewis and OSCA Personnel Services Director Gary Phillips to encourage judges to bring their loyalty oaths up to date in an October 2007 memo to all chief judges and courts administrators.

Hurt did not succeed in convincing Florida officials to hold new elections or to discharge all elected and appointed officers who did not have valid loyalty oaths on file at the beginning of their present terms. “That would have destroyed the superstructure of Florida’s government,” Hurt mused. “No elected officials in the state lawfully hold office. All suffer from defective or missing oaths, and I wouldn’t mind seeing them do a little jail time to wake them up to their number one public responsibility. Just wait till angry victims of judicial abuse start suing to vacate void judgments. It could become a landslide of litigation.” Hurt maintains a mailing list of over 900 subscribers to whom he sends his research results. Thompson seemed upbeat when he distributed copies of his lawsuit to hundreds of recipients, including intended targets of his complaint. “I am delighted to provide the below and attached to you thugs who run The Florida Bar,” he wrote. “I do so on the eve of a national holiday by which we celebrate and give thanks to the brave men and women who sacrificed so that we might live in a nation in which government of the people, by the people, and for the people might not perish.”
